Javier Aguirre es Profesor Asistente e Investigador de la Escuela de Filosofía de la Universidad Industrial de Santander – Colombia, adscrito al Grupo de Investigación Politeia. Es Abogado, Filósofo y Especialista en Docencia Universitaria de la misma Universidad. Becario Fulbright 2008. Actualmente adelanta estudios de Doctorado en Filosofía en la State University of New York at Stony Brook. Las áreas de trabajo e investigación del Profesor son la Filosofía del Derecho, la Filosofía Política y la Teoría de la Argumentación. El Profesor Aguirre ha escrito, en coautoría, los siguientes libros: La relación lenguaje – derecho: Habermas y el debate iusfilosófico; Justicia y Derechos en la Convivencia Escolar; Lógica y Teoría de la Argumentación y Carlos Marx y la crítica de los derechos.
HACIA UNA CONCEPCION HEGELIANA DE LA DIGNIDAD HUMANA. PRIMER PASO: LA SUPERACION DEL DUALISMO NATURAL VS. SOCIAL
La hipótesis que en esta ponencia se pondrá a prueba es que algunos de los momentos y movimientos del Espíritu, tal y como Hegel los presenta en su Fenomenología, pueden ser usados para desarrollar un análisis de la dignidad humana que se dirija a superar sus propios dualismos que hacen de ella un blanco fácil del criticismo y el escepticismo. En estricto sentido, por lo tanto, más que de una “concepción hegeliana de la dignidad humana”, con todo lo que eso puede implicar, de lo que se trata en el presente texto es de evidenciar cómo la filosofía de Hegel, en especial su Fenomenología, contiene valiosas herramientas conceptuales para abordar los debates contemporáneos jurídico – políticos, en especial en el ámbito del Derecho Internacional de los Derechos Humanos, acerca del significado de la dignidad humana.

Javier Aguirre is Assistant Professor and Researcher of the Philosophy Department at the Universidad Industrial of Santander – Colombia. He is member of the Research Group Politeia. He is Lawyer, Philosopher and Specialist in University Teaching of the same University. He is a Fulbright Scholarship 2008. Currently, he is a Doctoral Student of Philosophy at the State University of New York - Stony Brook. His research areas are the Philosophy of the Right, the Political Philosophy and the Argumentation Theory. Professor Aguirre has co-written, the following books: The Language – Law relation: Habermas and the iusphilosophic debate; Justice and Rights in the Scholar Coexistence; Logic and Argumentation Theory; and Karl Marx and the Rights Critics”.

The hypothesis that will be tested in this text is that some of Spirit’s movements, as Hegel presents them in his Phenomenology, can be used to develop an analysis of the concept of human dignity directed to overcome its own dualisms; dualisms that make of it an easy target for criticism and scepticism. In strict sense, therefore, rather than a “Hegelian concept of human dignity”, with everything that it may involve, this text is intended to highlight how Hegel’s philosophy, in particular his Phenomenology, contains valuable conceptual tools to clarify legal and political contemporary debates, especially in the field of the Human Rights International Law, about the meaning of human dignity.
